
Timacuan is often referred to by visitors as a beautiful community, one where it is obvious people care about their homes. Driving through our neighborhoods, it's easy to see why visitors feel that way. As residents, we know that our pleasing appearance and great property values are due to following the covenants that were put into place to ensure that Timacuan remains attractive to both the eye and the pocketbook. Since we know that time is a commodity in short supply today and that you probably haven't had time to read all your documents, we have included a summary of the key covenants here. Architectural changes
To ensure the aesthetic appearance of the community and protect property values, all changes of an exterior nature must be approved before work is begun.
Exterior work includes but is not limited to: painting (even if same color), construction, additions, re-roofing, architectural enhancements, and major landscaping projects. Review of the proposed project is conducted by the Architectural Review Board and is based on the application and supporting documents provided by the homeowner. The homeowner must also obtain all necessary permits before beginning work. Go to "Forms and Requests" for an application for approval.
Assessments
Assessments are due and payable by no later than the 1st business day of each quarter, specifically in January, April, July and September. Individual statements are sent to each homeowner during the month prior to the month in which the quarterly payment is due. Late payments are subject to a fine of $25. Click here for mailing address. Business use of property
No trade or business may be conducted in or from any Residence, except that an owner or occupant residing in a Residence may conduct business activities within the Residence so long as:

The existence or operation of the business activity is not apparent or detectable by sight, sound, or smell from outside the Residence;

The business activity conforms to all zoning requirements for the Property;

The business activity does not involve persons coming onto the Property who do not reside in the Property or door-to-door solicitation of residents of the Property;
-
The business activity is consistent with the residential character of the Property and does not constitute a nuisance, or a hazardous or offensive use, or threaten the security or safety or threaten the security of the other residents of the Property, as determined in the sole discretion of the Board;

The business complies with all requirements of city codes and ordinances.

Commercial Vehicles
Commercial vehicles must be parked out of sight in the garage, with the door closed. Passenger vehicles with commercial markings must also be garaged unless the markings can be covered with magnetic shields of the same color as the vehicle. (Article VIII.12)
Garage Sales
To ensure the safety and well-being of residents and guests and reduce non-resident traffic through the community, the Association sponsors two (2) community-wide garage sales each year, one in the spring and one in the fall. Garage sales at other times are prohibited, except for ARB-approved moving and estate sales. Residents holding garage sales must also comply with all city ordinances and permit requirements which permit no more than two sales per year per city resident. (Article VIII.38.2)
Lawn Maintenance
Each owner or resident is responsible for maintaining his property in a neat and clean manner. Maintenance includes the regular cutting and edging of the lawn, trimming of trees and shrubs and mulching of perimeter beds. (Article VIII.7)
Parking
For both aesthetics and safety (children playing, emergency vehicle access) vehicles should always be parked in your garage or driveway. Street parking is limited by our covenants to 2 hours during the day, except for visitors, who may park for up to 6 hours if there is no space in the driveway. No overnight parking is permitted, and vehicles with commercial markings must always be parked out of sight unless the markings are covered with a magnetic cover of the same color as the vehicle. Portable Basketball Hoops
Timacuan’s documents do permit basketball hoops, but only if they are the portable kind. Permanently anchored hoops are not allowed. The exact wording of the covenant may be found in section 8.26, but the key elements are as follows:
Temporary (movable) basketball hoops are permitted, provided that they are: (1) put in the garage or out of view from the front of the home when not in use, and (2) that they do not present a nuisance or obstruction to others or block pedestrian or vehicular traffic at any time. The latter means that they cannot be placed in the street or on the sidewalk at any time. (Article VIII.26)
Roof, Sidewalks and driveways
Each homeowner or resident is required to maintain their property in a neat and clean manner, including roofs, driveways and sidewalks adjacent to the property line. Florida's weather is hard on our homes, and it is usually necessary to pressure wash or chemically treat (roof) these surfaces at least twice a year. (Article VII.7)
Trash & container storage
Except on trash days, garbage or other waste material must be stored in covered or sealed sanitary containers within the garage, buried underground, placed within an enclosure or concealed by means of a screening wall of material, similar to and compatible with the building. The design and location of outside enclosures must be structured as to not attract attention, and located in the most inconspicuous manner possible. Outside enclosures must be approved by the ARB before being constructed or installed. Detached or free standing enclosures are not permitted. (Article VIII.10)
